The state constitution is the fundamental law of the state. As such, it should
embody the aims and aspirations of the citizens of the state and serve as the
foundation for the state’s political life. It also should facilitate—rather than
retard—political, social, and economic progress in the state.
Despite their diversity, American state constitutions share certain common
features. A state constitution establishes the institutions of state government and
prescribes how those institutions shall operate.Through its rights guarantees and
its prohibitions on governmental action, a state constitution largely determines
the scope of state powers, and it distributes those powers among the branches of
state government and between state and locality. A state constitution also establishes qualifications for state office and prescribes how state officials are to be
chosen. Thus it channels political conflict in the state and provides mechanisms
for its resolution. In addition, many state constitutions, not content to structure
state government, enshrine fundamental policy choices, sometimes providing
broad direction for public policy and sometimes prescribing its content in considerable detail. It is therefore no exaggeration to suggest that the effectiveness
and responsiveness of state government, the policies that it pursues and the values that it advances, all depend fundamentally on the state constitution.

Book Description
The accession of eight post-communist countries of Central and Eastern Europe
(and also of Malta and Cyprus) to the European Union in 2004 has been heralded—
rightly—as perhaps the most important development in the history of European
integration so far. European enlargement and the resultant “coming together” of
the two parts of Europe raise a number of crucial questions about the operation
of constitutionalism, democracy and the rule of law at both the European and the
national level. While the impact of the enlargement on the constitutional structures
and practices of the EU has already generated a voluminous and rich scholarly
literature, the influence of the accession on constitutionalism, democracy, human
rights and the rule of law among the new member states has been largely ignored.
And yet it is a matter of fundamental importance not just for those new member
states but for the European Union as a whole.

States and law faculties of higher educational institutions are encouraged to
include international law as a core subject in their curricula. They are also
encouraged to introduce courses in international law for students studying law,
political science, social sciences and other relevant disciplines; they should study
the possibility of introducing topics of international law in the curricula of
schools at the primary and secondary levels. They should also consider
introducing public international law courses geared towards career training and
the establishment of clinical programmes in various areas of international law.
Co-operation between institutions at the university level among developing
countries, on the one hand, and their co-operation with those of developed
countries, on the other, should be encouraged.

During the emergence of sociology as an academic discipline the questions
about the origins, status and functions of constitutions were widely
posed. Indeed, for both thematic and methodological reasons, the analysis
of constitutions was a central aspect of early sociology. Sociology
developed, however ambiguously, as a critical intellectual response to the
theories and achievements of the Enlightenment in the eighteenth
century, the political dimension of which was centrally focused on the
theory and practice of constitutional rule. In its very origins, in fact,
sociology might be seen as a counter-movement to the political ideals of
the Enlightenment, which rejected the (alleged) normative deductivism
of Enlightenment theorists. In this respect, in particular, early sociology
was deeply concerned with theories of political legitimacy in the
Enlightenment, and it translated the revolutionary analysis of legitimacy
in the Enlightenment, focused on the normative claim that singular
rights and rationally generalized principles of legal validity were the
constitutional basis for legitimate statehood, into an account of legitimacy
which observed political orders as obtaining legitimacy through
internalistically complex, historically contingent and multi-levelled processes
of legal formation and societal motivation and cohesion.

Two decades ago, Martin Shapiro urged public law scholars to expand their
horizons and begin studying “any public law other than constitutional law,
any court other than the Supreme Court, any public lawmaker other then the
judge, and any country other than the United States” (Shapiro 1989). Shapiro
recognized that American public law scholarship stood at the margins of political
science because it did not adequately engage the broad questions in the
field. Perhaps more importantly, Shapiro recognized that judicial institutions
had become important political players in a number of countries and that a
“judicialization of politics” was on the advance across much of the world.
Since Shapiro’s first call for more comparative scholarship, there has been
an explosion in the judicial politics literature focused on a variety of regions
and themes, including the role of courts in democratizing countries, the
relationship between law and social movements, and the judicialization of
international politics. However, there has been relatively little research on
the dynamics of judicial politics in non-democracies.1 This gap in the literature
is likely the result of a long-standing presumption among many political
scientists that courts in authoritarian regimes serve as mere pawns of their
rulers, and that they therefore lack any independent influence in political life.
This volume is intended to help readers understand the relationship
between international law and international relations (IL/IR). As a testament
to this dynamic area of inquiry, new research on IL/IR is now being
published in a growing list of traditional law reviews and disciplinary
journals. The excerpted articles in this volume, all of which were first
published in International Organization, represent some of the most
important research since serious social science scholarship began in
this area more than twenty years ago. They are important milestones
toward making IL/IR a central concern of scholarly research in
international affairs. The contributions have been selected to cover
some of the main topics of international affairs and to provide readers
with a range of theoretical perspectives, concepts, and heuristics that

The objective of the Act is stated to be ‘to give further effect’ in UK law to
the majority of the rights provided for in the European Convention of Human
Rights (‘the Convention’). The Act does not create new substantive rights
under domestic law, but it makes existing Convention rights more immediate
and relevant.
Law, Order and Freedom gives an account of the history of Western legal and
political philosophy. It focuses on law as a system of norms which aspires to provide
a fair balance between order and freedom. This liberal ideal of law and justice
is a distinctive feature of many present-day constitutions, specifically in Western
culture. Western legal orders are permeated with the principles of Enlightenment
philosophy, that is, liberty, equality, and (to a lesser degree) fraternity, which
have been translated into the institutions of the democratic constitutional state
with its characteristic rule of law, separation of powers and human rights. Judicial
interpretation too takes place within this spirit.
The fifth edition of this book that appeared in 2003 has been extensively
revised. To mark the growing importance of the international prosecution
of alleged war criminals and others accused of egregious crimes, a
new chapter on Individual Criminal Responsibility in International Law
has been introduced. The chapter on Air and Space Law has had to be
removed, with the section on Outer Space being moved to the chapter
on Territory. The increasing significance of the International Court of
Justice is recognised by devoting a separate chapter to it. The section on
the International Tribunal for the Law of the Sea has been moved to the
chapter on the Law of the Sea. The other chapters in the book have been
re-examined, updated and, where necessary, rewritten. I have also been
able to correct some errors. I am particularly delighted that the book
has been translated into, among other languages, Chinese, Polish, Hungarian
and Portuguese and I am very grateful for the work of all those
involved.

portant treaties remain unratified, and others have been ratified only with
large numbers of reservations, declarations, and understandings designed to limit their
impact. The tentativeness of this commitment may well stem in part from the unfamiliarity of human rights and humanitarian law to many in the United States, including a
large segment of its legal profession. The comparative analysis with U.S. law may offer a
small contribution to demystifying and clarifying to a U.S. audience the ramifications of
a full commitment to human rights and humanitarian law.
We then address procedural and substantive law, which constitutes the major proportion of the book. In the sections dealing with substantive law, we have focused on issues
the we believe a U.S. law student audience would find especially interesting and timely.
Such issues include abortion, the death penalty, torture, gay rights, war crimes, genocide
and discrimination, freedom of speech, and economic rights.
Finally, we have placed theoretical materials at the end of the book to suggest that a
more abstract and critical treatment of international human rights law and international
humanitarian law may be best approached after one has become familiar with the substantive and procedural law. We have attempted to give the reader a taste of different
theoretical and critical approaches from a variety of viewpoints.
Beyond the pedagogical purposes of this book, we hope that in exposing the law
student to the full range of current human rights and humanitarian legal issues, this
book will illuminate the future promise of human rights and humanitarian law as a
means of protecting individuals and groups facing persecution. The inspiration of that
promise – and the responsibilities it imposes – sustain the efforts of countless advocates
for international human rights and humanitarian law.

the present work provides a useful starting point for research, lawyers and academics will
